Photographs, commonly utilized to assist the jury's understanding of a crime, have been widely accepted as evidence in court for decades (e.g., victim injury, manner of demise). However, scholars and legal critics express concern that exceptionally violent and gruesome images prejudice juror and jury decision making, consequently violating the defendant's constitutional due process right to a fair trial. The present research examined the effect of photographic crime scene evidence on juror and jury decision making in a realistic murder trial simulation. A one-way experimental research design evaluated the effects of color, black and white, or no photograph on juror verdicts, verdict confidence, perceived impartiality, and emotional reactions. Results demonstrated that photographic crime scene evidence exerted no effect on juror verdicts and verdict confidence prior to deliberation. However, the findings indicated that evidence strength and deliberation may mediate the effect of photographic crime scene evidence on juror verdicts and verdict confidence, relative to predeliberation leanings of the majority of the jurors. Results suggest that a CSI effect, indicating juror desensitization to violence and enhanced expectation concrete evidence of defendant guilt (particularly DNA evidence), may have diffused the impact of photographic crime scene evidence on juror judgment and emotion. Findings illuminated the possible biasing effects of photographic evidence, specifically in terms of jury deliberation, and provided information about the decision-making processes of jury-eligible adults exposed to such evidence in a criminal murder trial.
