Previous research has found that jurors considered to be death qualified tend to be more conviction prone than non-death qualified jurors (Haney, 1984a, 1984b) and they tend to deliberate in a less thorough manner (i.e., they look at more aggravating and less mitigating evidence than non-death qualified jurors; Butler & Moran, 2002; Luginbuhl & Middendorf, 1988). It has also been demonstrated that at the individual level the Death Penalty Attitudes Scale (DPAS) is more predictive of verdict (guilty versus not guilty) and sentence (life versus death) than are standard death qualification questions. Therefore, the purpose of the current study was to assess, at the group level, the extent to which support for the death penalty (as measured by the DPAS) affects group level sentencing decisions (life versus death) as well as deliberation as measured by the group's use of evidence in comparison to juries chosen with standard death qualification questions. This information has been combined with social justice scheme (SJS) theory in an attempt to better understand how different matrices of juries differ in overall decisions. Overall, no major differences were found between juries chosen with standard questions and those chosen with the DPAS. Specifically, juries from both conditions followed the majority rules model of SJS. In addition, there was not a significant difference in final decisions, although what difference there was was in the opposite direction of that which was predicted. There was also no significant difference in group DPAS scores between those that chose death and those that chose life without parole. Finally, there was not a group level difference in the types of evidence considered between conditions, although there was a difference in the amount of aggravating evidence considered at the individual level. Limitations and suggestions for future research are discussed.
